1. Introduction
Welcome to AfricaDecides (“the Platform”), a product of Executive captionz Limited. These Terms of Use govern your access to and use of the Platform, including voting, competitions, elections, event ticketing, registration forms and related services. By using the Platform, you agree to these Terms.
2. Definitions
- “Platform” means the AfricaDecides website and related services.
- “We”, “us” or “our” means Executive captionz Limited, the operator of the Platform.
- “Organiser” means a person or entity that creates a project on the Platform.
- “Voter” means a registered user who casts a vote or ballot.
- “Service Fees” means fees charged for paid votes, tickets and other paid features.
3. Eligibility
You must be at least 18 years old, or have parental or guardian consent, to use the Platform. Organisers must be authorised to represent the organisation they register. You must provide accurate, current and complete information when creating an account.
4. User accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms or are used for fraudulent activity.
5. Voting rules
Votes must be cast by real individuals. We reserve the right to remove fraudulent votes, disqualify contestants or contestants, and withhold payouts where manipulation is detected. Free votes are typically limited to one per 24-hour period per contest unless otherwise stated.
6. Election mode
In Election Mode, ballots are secret and each verified voter is permitted one ballot per election. Results are released only according to the organiser’s chosen settings. We provide audit trails for election officers but do not reveal individual voter choices to organisers or administrators.
7. Payments, refunds and payouts
Paid votes and tickets are processed through our Mobile Money and card payment partners. All charges are displayed before confirmation. Refunds are handled according to our Refund Policy. Organisers may request payouts subject to our commission and verification process.
8. Prohibited conduct
You may not use the Platform to:
- manipulate votes, ballots, payments or results;
- impersonate another person or organisation;
- upload unlawful, defamatory, hateful or explicit content;
- interfere with the security or performance of the Platform;
- harass other users, contestants, candidates or officials.
9. Intellectual property
Executive captionz Limited retains all rights in the Platform name, software, design and branding. Organisers retain rights in their own content and are responsible for ensuring they have permission to use uploaded images, names and logos.
10. Limitation of liability
To the fullest extent permitted by law, Executive captionz Limited is not liable for indirect, incidental or consequential damages arising from your use of the Platform. Our total liability is limited to the amount you paid to us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your access at any time for breach of these Terms, fraud, legal obligations or technical necessity. Organisers remain responsible for settling any outstanding obligations with voters or ticket holders.
12. Governing law
These Terms are governed by the laws of the Republic of Uganda. Any disputes shall be resolved in the courts of Uganda, with a good-faith attempt to resolve matters informally first.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Platform after changes means you accept the revised Terms. Material changes will be communicated by email or notice on the Platform.
